Horowitz, a 65-year-old making his second decision as baseballs independent arbitrator, trimmed the discipline to 162 games, plus all post-season games in 2014. "While this length of suspension may be unprecedented for a MLB player, so is the misconduct he committed," Horowitz wrote. Horowitz concluded Rodriguez used testosterone, human growth hormone and Insulin-like growth factor-1 in 2010, 2011 and 2012 in violation of baseballs Joint Drug Agreement. He relied on evidence provided by the founder of the now-closed Biogenesis of America anti-aging clinic in Florida. "Direct evidence of those violations was supplied by the testimony of Anthony Bosch and corroborated with excerpts from Boschs personal composition notebooks, BBMs (Blackberry messages) exchanged between Bosch and Rodriguez, and reasonable inferences drawn from the entire record of evidence," Horowitz wrote. "The testimony was direct, credible and squarely corroborated by excerpts from several of the hundreds of pages of his composition notebooks." While the original notebooks were stolen, Horowitz allowed copies into evidence. Rodriguezs suit accused the Major League Baseball Players Association of "bad faith," said its representation during the hearing was "perfunctory at best" and accused it of failing to attack a civil suit filed by MLB in Florida state court as part of its Biogenesis investigation. His lawyers criticized Michael Weiner, the union head who died from a brain tumour in November, for saying last summer he recommended Rodriguez settle for a lesser penalty if MLB were to offer an acceptable length. "His claim is completely without merit, and we will aggressively defend ourselves and our members from these baseless charges," new union head Tony Clark said in a statement. "The players association has vigorously defended Mr. Rodriguezs rights throughout the Biogenesis investigation, and indeed throughout his career. Mr. Rodriguezs allegation that the association has failed to fairly represent him is outrageous, and his gratuitous attacks on our former executive director, Michael Weiner, are inexcusable." The suit also claimed MLB engaged in "ethically challenged behaviour" and was the source of media leaks in violation of baseballs confidentiality rules. Rodriguezs lawyers said Horowitz acted "with evident partiality" and "refused to entertain evidence that was pertinent and material." They faulted Horowitz for denying Rodriguezs request to have a different arbitrator hear the case, for not ordering Selig to testify and for allowing Bosch to claim Fifth Amendment rights against self-incrimination in refusing to answer questions during cross-examination. They also said Horowitz let the league introduce "unauthenticated documents and hearsay evidence ... obtained by theft, coercion or payment," wouldnt allow them to examine Blackberry devices introduced by MLB and was fearful he would be fired if he didnt side with management. Rodriguez asked the court to throw out Horowitzs decision and find the league violated its agreements with the union and that the union breached its duty to represent him. The case was assigned to U.S. District Judge Edgardo Ramos. Supreme Court decisions have set narrow grounds for judges to vacate arbitration decisions, instances such as corruption or not following the rules agreed to by the parties. "Once when Bosch sent a message telling Rodriguez that he was going to pick up Rodriguezs meds, Rodriguez replied Not meds dude. Food," the arbitrator wrote. Rodriguez did not testify in the grievance, walking out after Horowitz refused to order Selig to testify. At a brief hearing Monday, MLB said it would not discipline Rodriguez for including the decision in his lawsuit. U.S. District Judge William H. Pauley III brushed aside concerns from the union about confidentiality concerns. "Given the intense public interest in this matter and Commissioner Seligs disclosures last night on 60 Minutes, its difficult to imagine that any portion of this proceeding should be under seal," Pauley said. The arbitrator noted Bosch and Rodriguez exchanged 556 text messages and had 53 telephone calls in 2012. He said all records of text messages were produced by Bosch, while lawyers for Rodriguez said the Blackberry he used to communicate with Bosch was deactivated last March and Rodriguez no longer had it. The arbitrator said Rodriguez instructed Bosch in one message to "erase all these messages." Horowitz recounted how Rodriguez was introduced to Bosch after a Yankees game in Tampa, Fla., in July 2010 by A-Rods cousin, Yuri Sucart, who knew Bosch through Jorge "Oggi" Velazquez. Horowitz wrote MLB was justified in citing violations of the collective bargaining agreement because Rodriguez "played an active role in inducing Bosch to issue his own public denial on Jan. 29" and "attempted to induce Bosch to sign a sworn statement on May 31" saying he never supplied the player. In determining the length of the penalty, Horowitz cited a 2008 decision in a grievance involving Neifi Perez in which arbitrator Shyam Das ruled "separate uses are subject to separate disciplines." He said under the discipline system for positive tests, Rodriguez would be subject to at least 150 games for three violations of 50 games. Still, Horowitz thought Seligs initial penalty was too severe. "A suspension of one season satisfies the structures of just cause as commensurate with the severity of his violations," he wrote. Rodriguezs lawyers claimed at worst the case should involve one first violation with a penalty of 50 games, and they said including the 2014 post-season was beyond the scope of Seligs original discipline. Horowitz rejected Rodriguezs argument that the lack of a positive test was proof of innocence. "It is recognized Rodriguez passed 11 drug tests administered by MLB from 2010 through 2012. The assertion that Rodriguez would have failed those tests had he consumed those PES as alleged is not persuasive. As advanced as MLBs program has become, no drug-testing program will catch every player," Horowitz wrote. Regardless of just how difficult it might be to "bite your tongue" in the heat of the moment, any profane outburst from a ref becomes indefensible. A refs credibility and respect can be damaged (at least temporarily) when negative emotions are inappropriately vented in public as we witnessed in this situation. Im positive that referee Paul Devorski regrets the poor conduct he demonstrated by sharing his feelings with colleague Dan ORourke in what he thought to be a private exchange. He should know that nothing is private anymore; if he didnt he does now. It matters little that referee Devorski was the recipient of Vancouver Coach John Tortorellas profanity-laced attack; lip reading aside! What matters most is that the referee is entrusted with the authority to act as an impartial arbitrator and conduct himself in a professional manner at all times. You can rest assured that Paul Devorski has already been spoken to about this incident by someone from within Hockey Operations and/or the Officiating Department. There are also times when an Officials assignments will be altered to keep from throwing gasoline on smoldering ashes that remain from a previous game or incident. Moving personnel is not always easy with back-to-back games and especially on the West Coast. While the referees conduct was inappropriate it demonstrates something none of us should lose sight of. These guys are only human! There isnt a referee that hasnt slipped up and cursed at one time or another. I know for sure I have. I learned early in my career however that if I was expected to control the game and the negative emotions that often surfaced in disputes, it was imperative that I maintain control my own emotions. Believe me when I tell you there were many times that this good intention was much easier said than done! I adopted the adage, "Treat disrespect, with respect" to gain leverage and exert control in heated exchanges with players and coaches. In an effort to quickly bring the temperature down, I incorporated non aggressive body language (open palms vs finger point) and a monotone voice inflection (vs elevated volume and shouting match). I attempted to quickly set the tone and establish an element of control during the dispute through my actions by demonstrating a calm but firm demeanor. I encouraged the other party to engage in a civil conversation as opposed to a giving or receiving a profanity laced lecture. Through the "conversation" that generally followed I listened as the player or coach expressed their opinion. I then explained the reasoning behind my decision. In the end we might just agree to disagree. Regardless of the eventual outcome an effort was always made to solicit some form of civil decorum. To maintain self-control as a referee it is important to feel your internal emotional pitch rise and fall like the mercury of a thermometer (Think of any bouts of road rage you have been a party to?). You better think before you speak and when you do listen to yourself; the tone, the volume and how it is being perceived. I was in a heated debate with a player one time when I stopped abruptly in midsentence. I apologized for what I had just heard myself say to the player that I deemed inappropriate; I knew he must have as well. I withdrew my inappropriate comment by stating, "Im sorry, that came out the wrong way; what I meant to say was this". It is especially important for the referee to be part of the solution as opposed to part of the problem. Sometimes it takes super-human strength to keep your emotions in check. In the 1974-75 season, I was assigned to an IHL game in Flint, MI. Late in the third period I assessed multiple penalties to Muskegon Mohawks defenceman Lynn Margarit following a fight. Margarit amassed 301 penalty minutes that season and 2,100 during his 10-year IHL career. The player and I engaged in a heated, nose to nose debate over the game misconduct he had received. In his rage, and as I opened my mouth to speak, Margarit spat directly into my mouth! It immediately sickened me. Every muscle in my body immediately shook with rage in readiness to drill this guy. Just after 1:30pm in the afternoon, inside the blistering heat of Giants Stadium, New Jersey, the Germans led 1-0 in a World Cup quarterfinal against Bulgaria with 15 minutes left in the match. The reigning World Champions were about to become the first ever country to reach four straight World Cup semifinals. Bulgaria suddenly scored two goals in three minutes and in a New York minute the Germans were going home. The football world was stunned. No one since has made the final four of the World Cup four times in a row. Until today. Fittingly, it was Germany again, playing on another hot afternoon, and up a goal on their opponents. This time, though, there was no meltdown in the heat. Lows mind will be full of exceptional memories of Ozil performing brilliantly at the last two major tournaments. He remains good at spatial awareness and in possession when given outlets close by. This is the biggest question going forward. Despite getting by two good sides they look very average relying on Neymars pace and creativity in the final third. Without Neymar, they have no real plan B in attack. Even when they are scoring, he is the one creating them. Neymars speed again made a massive difference. Thats kind of what started it," Paul Stauskas said. "And if a kid enjoys doing something, whether theyre golfing or skating or whatever, when you do it enough times, you become really good at it." Stauskas became really good after the family moved to their Mississauga home when he was in Grade 5. His dad wanted to install either a pool, a putting green or a basketball court in the backyard. They went with the court, because Nik was "just so enthusiastic about basketball and went above and beyond the call of duty to work on his game," Paul said. The dad wanted the best for his boys — Nik has an older brother Peter — so had the court installed by a company that specializes in modular sports flooring. The backyard court, the first by this company in Canada, is made of interlocking tiles that both gives the feel of a real court surface, and help prevent ankle problems and shin splints. Good thing, because Stauskas would practically live on that court for the next several years. In the winter, he would plug in a space heater to warm his hands. Its also a good thing, Paul said, that he chose the court over the putting green. "Maybe Id be a much better golfer," he said. "But Im 100 per cent convinced Nik would not be where he is today if we had not done that. "This was just one of those things, he could be by himself and he was just happy as a lark, he didnt need anybody, he could be there for hours, flicking shots. And you know how kids get, they start playing games in their head and they start fantasizing that theyre hitting the last-second shot in an important game. Hed just play games with himself, just very happy." Stauskas shared his backyard shooting exploits online, turning into a bit of a YouTube showman. In one video, shot on Christmas Eve of 2012, Stauskas, in tuque and track suit, dropped 45 of 50 three-point shots. In another, shot on a rainy day last spring, he made good on 70 of 76 attempts — including 46 in a row — in the span of five minutes. That YouTube video has over 500,000 views, and even caught the attention of Stephen Curry. Paul Stauskas remembers it was a couple of tuba players on the school band that came up with the maize-and-blue version of the Maple Leaf that flew at games in Ann Arbor. "When Rondo first came in the league, both me and Nik saw his very first game and we looked at each other and we go, Wow, is this guy good. So imagine we see this guy and a few years later (Niks) playing side-by-side with him. Its crazy." Rowan Barrett, the assistant GM of Canadas mens basketball program, saw Stauskas play in high school when he was a 15-year-old at Mississaugas Loyola Catholic School. "It was clear that there was talent, there was ability," Barrett said. "The keys you wanted to know were: What was his mind like? And how much would he be willing to work at it? The great thing is he is excellent in both of those areas. Tremendous work ethic and definitely has the mind of a winner. You put those things together with size and length and skill, and you can find yourself a pretty good basketball player. "Im very excited for him."
